6.5 Acknowledgement of Service
By completing a payment on InternAVIA, you expressly acknowledge that: (i) you have reviewed and accepted the applicable fee schedule; (ii) the payment is made voluntarily and with full understanding of the service being purchased; and (iii) EWS will begin processing your application or subscription upon receipt of confirmed payment.
6.6 Chargeback Waiver
You hereby expressly and irrevocably waive any right to initiate a chargeback, dispute, or reversal of any payment made to EWS through any credit card, debit card, UPI, net banking, or any other payment instrument, on any ground whatsoever — including but not limited to non-delivery of service, dissatisfaction with outcome, or alleged fraud — once EWS has commenced performance of the service. This waiver is a material condition of this agreement. EWS shall not be required to participate in or be bound by any chargeback proceedings initiated in violation of this clause.
Refunds, if applicable, shall be governed exclusively by EWS’s Refund Policy as published on the platform. EWS offers no guarantee as to the timeliness of refunds reaching your bank or card account, which is subject to your bank’s processing timelines.
06AStipend Payment Obligation (Airport Partners)
Airport Partners (host organisations) who accept an intern placed through InternAVIA unconditionally agree to the following:
6A.1 Stipend Commitment
The monthly stipend payable to the intern shall be as mutually agreed and documented in the Airport Partner Agreement or Memorandum of Understanding (“MOU”) executed between Elite World Services Limited and the Host Organisation prior to placement. In the absence of a specific written agreement, the stipend shall be as stated in the intern’s Offer Letter issued by EWS. No Airport Partner shall pay a stipend lower than the amount specified in their applicable MOU or Offer Letter without prior written consent from EWS.
6A.2 Timely Payment
Stipend must be credited to the intern’s bank account on or before the last working day of each internship month. A delay exceeding 7 calendar days beyond the due date constitutes a material breach of this agreement.
6A.3 Probation Period
During the first 30 days of an internship (“Probation Period”), either the Airport Partner or EWS may terminate the placement. In such cases, the intern must be paid a pro-rata stipend for the days actually worked. No deduction may be made from the pro-rata amount on account of training, documentation, or administrative costs.
6A.4 Non-Payment Consequences
Failure to pay the agreed stipend, or any attempt to alter the stipend downward after placement without prior written consent from EWS, will result in: (i) immediate suspension of the Airport Partner’s access to InternAVIA; (ii) the matter being reported to relevant regulatory authorities; and (iii) EWS reserving the right to initiate appropriate legal proceedings.
6A.5 No Offset
Airport Partners may not offset unpaid stipend against any claim or dispute with EWS. Stipend obligations to the intern are independent of any commercial dispute between the Airport Partner and EWS.
06BStudent Data Restriction (Airport Partners)
By accessing student profiles, resumes, contact details, identification documents, or any other personal information through the InternAVIA platform (“Student Data”), Airport Partners expressly agree to the following:
6B.1 Purpose Limitation
Student Data may be accessed and used solely for the purpose of evaluating, onboarding, managing, and assessing interns placed through InternAVIA. Any other use is strictly prohibited.
6B.2 Prohibited Uses
Airport Partners are expressly prohibited from:
- Using Student Data for marketing, promotional communications, or solicitation unrelated to the placed internship;
- Transferring, selling, licensing, or sharing Student Data with any third party, affiliate, or associate;
- Retaining Student Data beyond 90 days after the conclusion of the internship without the student’s explicit written consent;
- Using Student Data to directly recruit the same student for a role that bypasses InternAVIA, within 12 months of placement, without prior written consent from EWS and payment of the applicable placement commission.
6B.3 Data Security
Airport Partners must store all Student Data securely and in compliance with applicable Indian data protection laws, including the Digital Personal Data Protection Act, 2023.
6B.4 Breach
Any violation of this clause shall entitle EWS to: (i) immediately terminate the Airport Partner’s access to InternAVIA; (ii) claim liquidated damages of ₹1,00,000 per student record misused; and (iii) initiate legal proceedings under applicable laws.
